Kate Payne heads the Commercial, Regulatory and Employment group.

Kate is an employment law specialist with extensive experience advising on complex employment disputes, team moves and issues in the insurance market.

Kate qualified as a solicitor in 1995 and became a partner in Elborne Mitchell in 2000.  Kate naturally gravitated to a firm specialising in insurance as a number of her family have been involved in this market one way or another.

In addition to experience in a variety of commercial transactions and disputes including corporate, shareholder and regulatory matters, Kate has extensive experience in dealing with a broad range of contentious and non-contentious employment issues acting for both employers and employees.  She has particular interest and expertise in dealing with team moves and advising on strategies to minimise the risks involved in team recruitment and related TUPE issues. She also advises on bonus and share disputes together with dismissals including redundancy and unfair dismissal.   Kate is regularly involved with advising on boardroom bust-ups and the enforceability of post termination restrictions in employment contracts.

Over the years, Kate has been involved in a number of high profile employment cases, many of these involving team moves.  These include the widely reported landmark case before the Court of Appeal of Samengo-Turner & Others v Marsh & McLennan, in which the Court of Appeal granted injunctive relief to prevent a team of London reinsurance brokers being sued in the US.  Kate has also advised on large scale international redundancy programmes and been involved in Employment Tribunal litigation including substantial unpaid bonus claims and a variety of discrimination claims.

Kate is a member of the Employment Lawyers Association and speaks on employment issues.  She is also a member of The Worshipful Company of Insurers.  Kate lives in Central London. In 2016 Kate ran the London Marathon for Breast Cancer Care.
